Montana’s Congressman, Denny Rehberg, today released the following statement critical of a proposed “emergency rule” by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to require federally licensed firearms retailers to report multiple sales of semi-automatic rifles. The proposed rule was included in today’s Federal Register and specifically calls for firearm retailers to report multiple sales, or other dispositions, of two or more .22 caliber or larger semi-automatic rifles that are capable of accepting a detachable magazine and are purchased by the same individual within five consecutive business days.

The lawyer for Dick Heller, the plaintiff in a U.S. Supreme Court case in 2008 that expanded Second Amendment rights, argued to the three judge panel today that the District of Columbia’s regulations are so burdensome that gun owners are deprived of their constitutional rights. The rules are inconsistent with high court rulings, including Heller’s earlier case, he said.
The lawsuit, dubbed Heller II by gun rights advocates, seeks to overturn restrictions the city imposed after Heller’s Supreme Court victory ended Washington’s almost total ban on guns.

Acting on behalf of a Georgia resident and honorably discharged Vietnam War veteran, the Second Amendment Foundation today filed a lawsuit against Attorney General Eric Holder and the Federal Bureau of Investigation over enforcement of a federal statute that can deny gun rights to someone with a simple misdemeanor conviction on his record.
